Professionals Terms and Conditions.
By submitting an application to Montana Luxury Estate Staffing (“the Agency”), you (“the Candidate”) agree to the following terms and conditions. These terms ensure a professional, secure, and respectful hiring process for both candidates and clients. Submission does not guarantee representation, job placement, or client introductions. Representation is granted solely at the Agency’s discretion and may be revoked at any time.
1. Representation & Accuracy
Candidates agree to provide truthful, complete, and accurate information regarding their background, experience, references, certifications, employment history, and character. Any omission or falsification is grounds for immediate disqualification and possible legal action.
2. Confidentiality & Non-Disclosure
Candidates agree to maintain strict confidentiality regarding all information obtained through Montana Luxury Estate Staffing, including but not limited to client names, locations, job descriptions, interview details, household information, and compensation.
Candidates may be required to sign a Non-Disclosure Agreement (NDA) prior to interviews or employment. Breaching confidentiality or the terms of an NDA is a serious violation and may result in immediate removal from our roster and potential legal action.
3. Social Media & Public Conduct
Candidates agree to maintain discretion and professionalism on all public platforms, including social media. This includes refraining from posting content that references, reveals, or implies any association with the Agency’s clients, their homes, children, properties, or lifestyle—whether directly or indirectly.
Additionally, candidates must avoid posting controversial, offensive, or unprofessional material that could damage the reputation of the Agency or be deemed inappropriate by potential employers. Your public presence may be reviewed as part of the screening process.
4. Client Interaction & Exclusivity
Once introduced to a client by the Agency, the Candidate agrees not to initiate direct communication or negotiate employment without Agency involvement. Any offer of employment—temporary, permanent, part-time, or full-time—must be coordinated through the Agency.
Any attempt to circumvent the Agency or accept direct employment without our involvement is a breach of contract and may result in legal and financial consequences.
5. Screening & Background Checks
Candidates must be willing to participate in our comprehensive vetting process. This may include:
Identity and work eligibility verification
Professional and personal reference checks
Background checks (criminal, civil, credit, etc.)
Driving record reports
Drug testing (if requested by client)
Skills or personality assessments
Failure to participate or provide consent for background screening may result in immediate disqualification from the candidate pool.
6. Trials & Temporary Engagements
Clients may request a trial period before offering permanent employment. Trial periods may range from one day to several weeks and may be paid or unpaid, depending on the arrangement.
The Agency will advocate for fair compensation during trials and ensure all expectations are clearly communicated. However, participation in a trial does not guarantee a job offer, and the Candidate agrees to approach trials professionally and respectfully.
7. Employment Terms & Legal Responsibility
Montana Luxury Estate Staffing is not the employer of record. The Agency functions strictly as a referral and placement service. Once a Candidate is hired, all employment terms—pay, benefits, taxes, hours, responsibilities, contracts, and termination—are solely between the Candidate and the hiring client.
Candidates are responsible for ensuring they comply with all legal and tax obligations associated with their employment.
8. Candidate Replacement Policy
In the event a Candidate is hired but leaves a role—either by resignation or termination—within the first 60 days of employment, the Agency may offer the client a one-time courtesy replacement at no additional cost. This is at the discretion of the Agency and subject to review.
Candidates who violate client agreements, misrepresent themselves, or behave unprofessionally may be excluded from future placements and forfeit any consideration for further representation.
9. Communication & Availability
Candidates are expected to maintain prompt, professional communication throughout the recruitment process. This includes responding to messages in a timely manner, showing up to interviews on time, and notifying the Agency of any changes to your availability, location, or employment status.
Failure to respond or remain engaged during the search process may result in removal from consideration for current or future roles.
10. Removal from Roster
The Agency reserves the right to remove any Candidate from our database or roster without notice, for any reason, including but not limited to:
Unprofessional conduct
Poor client feedback
Failure to communicate
Misrepresentation
Breach of confidentiality
Violation of these terms
11. Agreement
By submitting your application to Montana Luxury Estate Staffing, you confirm that you have read, understood, and agreed to all of the terms above. You understand that these conditions are designed to uphold the highest level of professionalism, discretion, and service to both clients and candidates.
