Terms and Conditions of Service Request Submission

By submitting a service inquiry to Montana Luxury Estate Staffing (“the Agency”), you (“the Client”) acknowledge and agree to the following terms and conditions. Submission of this form constitutes an expression of interest and does not create an obligation for the Agency to provide staffing services, nor does it guarantee placement of any personnel. All inquiries are subject to internal review and approval. The Agency reserves the right to decline service at any point if a request is deemed misaligned with our standards, if the Client fails to provide sufficient information, or for any reason we believe would compromise the integrity, safety, or professionalism of our process.

Upon mutual agreement to move forward, the Client will be required to pay a non-refundable Engagement Fee (ranging from $500–$1,000 depending on the complexity and urgency of the request) before the candidate search officially begins. This fee covers the time, resources, and expertise invested in sourcing, vetting, and presenting high-quality candidates. Should the Client proceed with hiring a candidate sourced by the Agency, a Placement Fee equal to 20% of the candidate’s agreed-upon annual gross salary will become due upon acceptance of employment, defined as the date the Client extends an offer and it is accepted—verbally or in writing. This includes full-time, part-time, ROTA, seasonal, temporary, and trial hires lasting more than 7 days.

The Placement Fee is applicable whether the candidate is hired directly or indirectly through the client or any related party, within 1 month of the initial introduction. Should the Client choose to hire any candidate introduced by the Agency at a later date, the Placement Fee will still apply.

Additional service fees may apply depending on the Client’s specific needs. These may include, but are not limited to: expedited placements, travel or lodging reimbursement for out-of-area candidates during the interview process, advanced or specialized background screenings, skills or psychometric assessments, extended onboarding or training support, and concierge relocation assistance. All additional costs will be discussed in advance and must be approved in writing by the Client before services are rendered.

All information exchanged between the Agency, the Client, and the candidates is to be treated as strictly confidential. The Client agrees not to disclose candidate identities, documents, or personal data to any third party without the written consent of the Agency. Any misuse of candidate information, including contacting a candidate outside the Agency’s knowledge or attempting to circumvent fees, constitutes a breach of contract and may result in legal action.

The Agency does not act as the employer of record. It is the Client’s responsibility to ensure legal compliance with all employment, tax, compensation, and insurance requirements once a hire is made. The Agency makes every effort to ensure that candidates presented are thoroughly vetted; however, we make no guarantees regarding performance or longevity.

By submitting this inquiry, the Client affirms that they have read, understood, and agreed to these terms in full. A formal Service Agreement outlining the scope of work, fees, refund policies (if applicable), and candidate replacement guarantees will be provided prior to initiating a search.
